Parliament censured Spanta last month for failing to stop the expulsion of Afghan refugees from Iran.

President Hamid Karzai referred the matter to the Supreme Court. The leader of the lower house, Yunus Qanuni, said parliament's decision is final and called on Karzai to select a new minister.
